Default Countrywide Home Loans Mod H*** or Highwater SUCCESS!!

Well...here is my story. I was a victim of Hurricane Rita in october 2005. As a result of this hardship. CW offered us a temporary suspension of payments. We were in an extreme hardship so we took it. When I asked what we would do at the end of the suspension we were told not to worry, CW would send us to their work out dept. and it would be no problem. Don't send any money now. We were stupid for believing them. Finally when CW decided to release the suspension, they began demanding all of the money upfront. Only would let us do a repayment plan, which we could not afford for obvious reasons. We have a 1st mortgage fixed at 6.25% for 85,000 and a 2nd HELOC adj currently at 8.25, but it has been as high as 11%. After numerous attempts, they offered us a short sale. We finally found a buyer, jumped through the work out hoops, faxed, called, waited, etc. then our buyer walked. Negotiator had the short sale approved, so closed out the request and we had to wait for another buyer. Found another buyer, same thing, couldn't get a loan. So after all of this, they offered us the mod. Reapplied, faxed, called, waited, etc. Finally got a negotiator after 2 mths, finally got a mod on our 1st loan, had to come up with $4,000 up front or else. The foreclosure had never been sent, thank God! So finally, this is approved, but they wouldn't the 1st and 2nd at the same time. So we get another negotiator for the 2nd, finally after waiting some more. It had been 8 mths now, all along they are reporting we are not paying to credit, but telling us not to send anything if we don't have the whole amt b/c it would be sent back. finally 2nd approved, get the documents, sign, notarize,etc. Send back, didn't hear anything, call to check, negotiator says they never received them. Request closed, start over. I was livid, these people are crooks!!! So start all over in January, call, fax, call, wait, etc. In Feb. called and had a negotiator, actually got an extension, called him, no return call. Kept calling, nothing, no updates. He will call you when he needs you. Finally on April 24, I get a call that I had been denied b/c they could not locate me!!! What!!! Well, needless to say they had in the computer we had applied again for work out on our 1st and 2nd, not just the 2nd and they were calling about the 1st. How can they say they couldn't find me when they called me. They are nuts!! So, I filed a complaint with the BBB. Best thing I ever did. Within days, literally days, a nice lady from Customer Concerns or Care called me. I told her I wanted my credit repaired back to my original request and an update on my mod for my 2nd. She was very informative, got back to me when she said she would and actually answered her phone. She got the newly assigned negotiator, yes another one, to call me last Friday. She tells me I have to send 30% or 3,180 in 48 yrs or request closed out and I will have to reapply. I was crazy again, I thought I have waited 4 mths for you to demand money in 48 hrs. So I call customer care girl back, she will try to help. Then negotiator manager calls me, she tells the same thing, this is inventor rules she says. Whatever!! She says maam you haven't paid in 2 yrs, do you expect me to be sympathetic? I said I was told not to pay, she said I was lying. I tried to argue, but it did no good. So, she asks her manager, no help. Get the money or else!!! We are trying to get the money, she gave until this afternoon. These people are nuts!!! She tells me maam, what company in their right mind would refuse a payment!!! Then she tells me she's new to CW, surprise!!! She did have some sympathy, she told me if we didn't get the money, and they had to close it out, when I did get it, Call back 8006690102, reapply, then call her and she will expedite my process. Finally someone with a heart at CW. You have send the complaint the BBB of Santa Barbara, they take all CW complaints. Do a search for BBB of SB, you can submit complaint right there.
