I called my Mortgage co and asked them why, when my loan was rescinded and they had agreed to request to the state, NJ, that they would not foreclose, why they now are?

They were non compliant with the rescission and now the foreclosure. The next day, the 16 of April, they called and then followed up with a letter, they withdrawal foreclosure. They did note public record, lis pendens, discharged, but I called yesterday and they have not sent notice to the court. My attorney knows, but as yet has not done anything.

I have emailed him. but I am realizing I have either one or two days to file answer. I can't remember if Sundays count in the 35 days I have to answer. I know they can't just foreclose, but there is one more notice I believe before they can even do anything. But it looks like I have ignored it. My situation is very much on the edge. Good or Bad? not sure.
