Please Plz Help!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!! I have spent HOURS hours hours trying to find out HOW to properly respond to this Mortgage Foreclosure Complaint that Homeq's attny filed w/our county 27 days ago. We had to "answer" within 30 days, and we've left messages with 2 different attorneys, who have not returned our calls. We can't afford to retain an attorney and still work this situation out w/Homeq (in case we do have to go w/the forbearance), and yet we don't qualify for Legal Aid. I am soooooooooooo stressed. I found a website that gives a sample "answer" to a complaint, and I started the legal document... however... there are questions in here that I hesitate to simply write "admits", "denies", or "don't know" to - as I read these are the appropriate options. For example - blah blah blah, borrower has failed to maintain mortgage payments and has broken contract. How do I say "yes, okay - we did it" without it biting us in the butt, legally?! Yet we want to be honest! I am so stressed-out about this, I just want to scream. With all the foreclosure info out there, there seems to be nothing regarding this part (answering the complaint). Is this one of those things that most people DON'T do, and so it just goes into foreclosure? Or.. because we've been talking w/Homeq, is it not necessary to answer the summons/complaint? We are soooooooooooooooooo confused over here, and don't know where to begin or what to do. Any and all help or direction/guidance is greatly appreciated, as always. p.s. - it says in the documents that if we don't file an answer w/the clerk's office, the Judgement will go into "default" and the home will officially go into foreclosure. |
