Default Do I need to be current in payments to ask for a loan mod?

I am new to this group and had resigned myself to foreclosure, as we have an adjustable neg am loan arm, which is coming due and we can't afford. I have not made a payment on either the first or second loan in four months and the foreclosure process has started. In addition to our home we have other properties in foreclosure (tried for over a year to sell them), and we realize we will have to declare bankruptcy when the dust settles. After finding this site, I feel like maybe there is hope and I want to start to process with the first loan on our home with American home mortgage and my question is this: do I need to get current on all payments, past due fees, etc...before I start the loss Mit process? I would rather not pay them a dime, till I know they will negotiate with me, as I have saved those funds for our next move/rainy day fund.
