I plan to file a Motion to Set Aside Summary Judgment against me in a foreclosure action because Bank of America doesn't have the original note and did not have it when the got the summary judgment. They have now filed to re-establish the note, which I have answered and challenged and denied the validity of the signatures and amounts described. Does anyone have a successful experience and advice or guidance that they would be willing to share? I plan to file first thing in the morning (Friday 3/21/08) Thanks in advance for your help.
